1.1 “Business” refers to Moments by M.R.
1.2 “Client” refers to the person or entity hiring equipment from the Business.
1.3 “Hire Items” means all props, equipment, décor, and accessories supplied by the Business, including but not limited to video guest book phones, backdrops, florals, signage, stands, and accessories.
1.4 “Hire Period” means the agreed period from delivery or collection of the Hire Items until their return.
2.1 These Terms & Conditions apply to all bookings made with the Business.
2.2 A booking is deemed accepted once the Client confirms the booking in writing and/or pays the required deposit.
2.3 By making a booking, the Client agrees to be bound by these Terms & Conditions.
3.1 All bookings are subject to availability of Hire Items.
3.2 The Business reserves the right to substitute Hire Items with comparable items if necessary.
4.1 All prices are quoted in AUD and include GST where applicable unless stated otherwise.
4.2 A non-refundable deposit of 25% may be required to secure the booking.
4.3 The full balance must be paid no later than 14 days prior to the event date unless otherwise agreed in writing.
4.4 Failure to make payment by the due date may result in cancellation of the booking without refund.
5.1 Client Cancellations:
5.2 Date Changes: Date changes are subject to availability and may incur an administration fee.
5.3 Business Cancellations: If the Business is unable to fulfil the booking due to circumstances beyond its control, all monies paid will be refunded in full. No further liability will apply.
6.1 Hire Items are supplied for use during the agreed Hire Period only.
6.2 The Client must ensure Hire Items are used solely for their intended purpose.
6.3 Hire Items must not be altered, relocated, sub-hired, or loaned without written consent from the Business.
7.1 Delivery, setup, and collection services are provided where agreed and may incur additional fees.
7.2 The Client must ensure safe access to the venue and suitable conditions for setup.
7.3 The Business is not responsible for delays caused by venue access issues, weather conditions, or third parties.
8.1 The Client accepts full responsibility for the Hire Items from the time of delivery or collection until they are returned.
8.2 The Client assumes all risk for loss, theft, or damage to the Hire Items during the Hire Period.
9.1 Hire Items must be returned in the same condition as supplied, excluding fair wear and tear.
9.2 The Client is liable for all costs associated with repair, replacement, or excessive cleaning of damaged or lost Hire Items.
9.3 Florals (real or artificial) must not be cut, painted, glued, or altered without prior approval.
10.1 The Client is responsible for the safe handling and security of video guest book phones at all times.
10.2 The Business is not responsible for lost, incomplete, or corrupted recordings due to misuse, guest error, power failure, or interference.
10.3 Recorded messages will be supplied digitally and retained for up to 60 days following the event.
11.1 Outdoor use of Hire Items must be disclosed at the time of booking.
11.2 Hire Items must be protected from rain, wind, heat, moisture, and extreme weather conditions.
11.3 The Business reserves the right to refuse setup or remove Hire Items if conditions pose a risk to safety or equipment.
12.1 To the maximum extent permitted by law, the Business is not liable for any personal injury, property damage, or indirect loss arising from use of the Hire Items.
12.2 The Business’s total liability is limited to the hire fee paid by the Client.
13.1 The Client agrees to indemnify the Business against any claims, damages, losses, or expenses arising from misuse of Hire Items or breach of these Terms & Conditions.
14.1 The Business may use images of Hire Items taken at events for marketing and promotional purposes unless the Client provides written notice prior to the event.
15.1 The Business is not liable for failure or delay in performance due to events beyond its reasonable control, including natural disasters, government restrictions, illness, or transport disruptions.
16.1 These Terms & Conditions are governed by the laws of Victoria, Australia.
16.2 Any disputes will be subject to the exclusive jurisdiction of the courts of that location.
17.1 These Terms & Conditions constitute the entire agreement between the Business and the Client.
